The Council of Ministers of Belarus has introduced a bill to the House of Representatives, which provides for the introduction of criminal liability for certain actions with civilian drones and aircraft models. Journalists Telegraf.news have studied the text of the draft and learned what exactly the lawmakers proposed to send Belarusians to prison for two years for.
If the Belarusian "deputies" approve the draft of the new law "On amending the codes on criminal and administrative responsibility," the Criminal Code of Belarus (CC RB) may soon be supplemented with another article - 300-1 "Illegal actions in relation to civilian drones and aircraft models. According to this article, Belarusians will face criminal punishment for violating the law on:
importation of civilian drones and aircraft models into the country,
storage,
turnover,
exploitation,
making.
It is proposed to qualify these actions under the criminal article, if a person is found guilty of such violations again within a year after the imposition of an administrative penalty for the same violations.
The range of proposed punishments under the new article of the Criminal Code is quite wide - from community service and a fine, to correctional work for up to 1 year and restriction or imprisonment for up to 2 years with or without a fine.

The Code of Administrative Offenses of the Republic of Belarus (CAO RB) was also proposed to be supplemented, in particular, with Article 18.38 - "Violation of requirements for state registration and operation of civilian drones." The article provides for a fine of 20-50 basic units with confiscation for individuals (up to 100 basic units with confiscation for individual entrepreneurs, up to 200 basic units with confiscation for legal entities) for the following actions with drones:
for importation to Belarus, as well as storage, circulation, operation and manufacture of civil unmanned aerial vehicles and aircraft models in violation of the requirements of the legislation;
for violation of the requirements for registration and de-registration of civil unmanned aerial vehicles;
for flying civil drones without applying a unique registration number of civil unmanned aerial vehicle and identification mark of the class of civil unmanned aerial vehicle to it,
for controlling a flight
In addition, the draft law sets out Article 18.35 "Violation of the rules of airspace use" in a new version. First, the lawmakers proposed to increase the maximum fine for violation of the rules of airspace use - from 20 to 50 basic units for individuals (up to 60 basic units for sole proprietorships and up to 100 basic units for legal entities).
The article also singles out the violation of rules of airspace use with the use of civil drones, ultralight aircraft such as gliders, hang gliders, paragliders, and aircraft of amateur design, aerostatic apparatus or aeromodels as a separate item. It was proposed to fine 5 to 50 basic units (from 10 to 100 basic units for private entrepreneurs and from 20 to 150 basic units for legal entities) with confiscation.
And finally, another article indirectly related to drones, which was also proposed to be included in the Code of Administrative Offenses of the Republic of Belarus - Article 13.36 "Delivery, delivery of international mail or goods without control". It provides for administrative liability for non-delivery of international mail or goods to individuals imported from the EAEU countries to the place of control or handing them over to an individual without proper control. It is proposed to impose a fine ranging from 10% to 25% of the value of the subject of the administrative offense (for individual entrepreneurs and legal entities - up to 50% of the value).
